Under section 43 of the Water Resources Act 2007 a licence must be obtained before constructing a new water control structure, altering an existing water control structure or commencing any other work in or on a waterway. Water control structures include dams (whether or not it is in or on a waterway) or any other water retention structure in or on a waterway.
When considering an application the Environment Protection Authority must be satisfied that the work will not adversely affect the flow or quality of the water, the aquatic habitat in the waterway or the interests of other water users. The Authority will consider whether there is a real need for the structure or if another more suitable approach is available and any other issues they consider relevant.
NOTE: Before water can be taken from a waterway works structure, other than for stock and domestic purposes, a Licence to Take Water and a Water Access Entitlement are required.
