Under Section 49 of the Water Resources Act 2007, a recharge licence must be obtained before constructing, operating or altering any work for the purposes of increasing a quantity of groundwater.
When considering an application the Environment and Sustainable Development Directorate will take into account the applicant's environmental record, the risk of the rising level of groundwater damaging soil, rock or structures, the risk of damaging ecosystems, the risk of affecting the natural drainage of surface water and any other relevant issues.
