Intention to Vacate Rental Property Notification

A tenant can terminate a tenancy agreement by giving notice in the approved form where:

    • the lessor has breached the terms and conditions in the tenancy agreement;
    • the property is not fit for habitation or the property will not be available due to government action;
    • a fixed term tenancy agreement has ended; or
    • a tenancy agreement is periodic and the tenant gives the lessor 3 weeks notice.

Where a tenant terminates an agreement by notice, rent is still payable until the date specified in the notice of intention to vacate, or until the tenant vacates the property, whichever is the later. If a tenant abandons the property or does not give the lessor the correct 3 weeks written notice, then the lessor is entitled to claim compensation of up to 3 weeks rent from the tenant.
